FONT LICENSES EXPLAINED

This page provides an in depth explanation of my different font licensing options. If you are a freelance designer this largely doesn't apply to you unless you are developing Websites, E-publication or Applications. Freelancers creating Logos, Print Material/Posters, Merchandise, Static/Animated graphics for social media etc. are generally covered under my "FREELANCER" license. If you are unsure then please contact me and I will be happy to clarify.

Font License – Desktop

1. Grant of License

Tom Gordon Design LTD. (“Licensor”) grants the purchaser (“Licensee”) a perpetual, non-exclusive, worldwide, non-transferable license to install and use the Font Software on desktop and laptop computers for the creation of static designs and content.

2. Permitted Uses

Under this Desktop License, the Licensee may:

• Install the Font Software on up to the number of devices (owned or controlled by the Licensee) stated on the applicable order receipt (“Receipt”).
• Create logos, branding, packaging, printed materials, signage, social media graphics, advertisements, and other static visual content.
• Create and distribute rasterized or outlined artwork incorporating the fonts.
• Embed the fonts in non-editable PDF documents for viewing and printing.
• Use the fonts for commercial and personal projects.

3. Restrictions

The Licensee may not:

• Share, sell, sublicense, lend, or distribute the Font Software to third parties.
• Upload the Font Software to public repositories or file-sharing services.
• Use the Font Software in websites, mobile applications, software applications, eBooks, or digital products where the font files are embedded or accessible, unless an appropriate license is purchased.
• Create products whose primary value is the font software itself.

4. Ownership

The Font Software remains the intellectual property of Tom Gordon Design LTD. This license grants usage rights only and does not transfer ownership.

Font License – Webfont

1. Grant of License

Tom Gordon Design LTD. (“Licensor”) grants the purchaser (“Licensee”) a perpetual, non-exclusive, worldwide, non-transferable license to embed the Font Software on websites owned or controlled by the Licensee.

2. Permitted Uses

Under this Webfont License, the Licensee may:

• Use the font via CSS @font-face embedding.
• Self-host the provided webfont files or use them through a licensed hosting solution.
• Use the font across multiple domains owned by the Licensee.
• Use the font for both commercial and personal websites.

3. Restrictions

The Licensee may not:

• Use desktop font files (.OTF, .TTF, or similar) directly on websites.
• Exceed the total number of Page Views Per Month stated on the applicable order receipt (“Receipt”)
• Allow visitors to download, extract, or access the font files.
• Use the fonts on websites owned by clients without obtaining a separate license for the client.
• Convert the fonts into webfont formats for redistribution.

4. Security Requirements

The Licensee must take reasonable measures to prevent extraction, copying, or redistribution of the Font Software from the application.

Font License – eBook

1. Grant of License

Tom Gordon Design LTD. (“Licensor”) grants the purchaser (“Licensee”) a perpetual, non-exclusive, worldwide, non-transferable license to embed the Font Software within digital publications.

2. Permitted Uses

Under this eBook License, the Licensee may:

• Embed the fonts in EPUB, PDF, Kindle, Apple Books, and other standard eBook formats.
• Publish and distribute unlimited copies of licensed eBook titles.
• Update, revise, and republish licensed titles without purchasing an additional license.
• Subset or optimize the font files to improve file size and performance.

3. Title Allowance

The Licensee is authorized to embed the Fonts in up to the number of distinct eBook titles stated on the applicable order receipt (“Receipt”). Additional titles require an expanded license.

4. Restrictions

The Licensee may not:

• Distribute the Font Software as a standalone file.
• Permit end users to install or extract the fonts from the publication.
• Use the fonts within applications, websites, or software products without the appropriate license.

Font License – App

1. Grant of License

Tom Gordon Design LTD. (“Licensor”) grants the purchaser (“Licensee”) a perpetual, non-exclusive, worldwide, non-transferable license to embed the Font Software within software applications owned or controlled by the Licensee.

2. Permitted Uses

Under this App License, the Licensee may:

• Embed the Font Software in mobile, desktop, web-based, and gaming applications.
• Distribute unlimited copies of licensed applications.
• Release updates, patches, and future versions of licensed applications.
• Use the fonts across multiple operating systems and platforms.

3. Monthly Active Users Limit

Apps embedding the Fonts must not exceed the total number of Monthly Active Users (“MAU”) specified on the applicable order receipt (“Receipt”).

MAU may be calculated using either of the following methods:

The combined total number of unique users who have accessed or used the Apps within the preceding 30-day period; or

The combined total number of downloads across all Apps.

4. Restrictions

The Licensee may not:

• Include the fonts in products whose primary purpose is font creation, editing, or distribution.
• Allow visitors to download, extract, or access the font files.
• Use the fonts on websites owned by clients without obtaining a separate license for the client.
• Transfer the license to another company, product, or legal entity without written permission.

5. Security Requirements

The Licensee must take reasonable measures to prevent extraction, copying, or redistribution of the Font Software from the application.

6. Ownership

The Font Software remains the intellectual property of Tom Gordon Design LTD. This license grants usage rights only and does not transfer ownership.
